By-Law Enforcement Officer (PFT) (CUPE 39.24)

Basic Function:

Oversee the receipt, investigation and disposition of complaints and violations with respect to provincial statutes, regulations and local by-laws and to ensure that all legal requirements for County by-laws are adhered to.

Note: The hours of work for this position may include daytime, evening and weekend shifts and will be scheduled based on operational requirements.

Position Description:

  • Interpret Provincial Acts and regulations for the purpose of administering and enforcing the appropriate legislation.
  • Perform on-site inspections of By-Law violations by taking photographs and interviewing alleged violator(s) and other individuals as required
  • Maintain accurate and up to date notebook records of all activities
  • Maintain accurate and up to date investigative records using an internal database such as CityView.
  • Conduct land title searches.
  • Liaise with all levels of government and enforcement agencies.
  • Responsible for the issuance of various letters, notices and orders.
  • Prepare and swear affidavits, subpoenas and various other documentation and serve and file same, arrange initial court dates, the attendance of interested parties, and to prepare summarization of occurrence briefs for use in court by both the County Solicitor and/or external Counsel.
  • Attend Provincial Offences or Superior Court of Ontario for Examinations of Discovery and trials to provide testimony as required.
  • Act as a Provincial Offences Officer in the enforcement of Provincial Acts and Municipal By-Laws including but not limited to: receiving and documenting verbal and written complaints, and serving orders.
  • Prepare written submissions using eScribe. Follow up attendance at By-Law Appeals Committee hearings and Council meetings for the purpose of briefing members when required.
  • Issue Provincial Offences tickets and prepare control sheets for Ontario Court, Provincial Division.
  • Prepare cases for court based on thorough and appropriate investigation.
  • Research and review new or amended legislation specifically as it relates to County By-Laws.
  • Assist with updates to and development of By-laws
  • To stay current with case law and how it affects interpretation and implementation of by-laws as well as other issues (i.e., Civil issues).
  • Other duties as assigned.

Requirements

Knowledge and Experience:

  • Successful completion of post-secondary education in Police Foundations, Law and Security, Law, or a Graduate of the Ontario Police College
  • A minimum of three years related experience such as the interpretation, administration and enforcement of provincial statutes, local by-laws, regulations, and legislation

Skills and Abilities:

  • Good working knowledge of the Ontario Provincial Offences Act, Building Code Act and Municipal Act
  • Possess excellent research, investigative and conflict resolution skills
  • Possess excellent written and verbal communication skills. Teaching and/or presenting to groups of people is considered an asset.
  • Superior organizational and time-management skills are required to be fully effective
  • Experience in the editing and creation of municipal by-laws is considered an asset.
  • Valid Ontario driver’s license and access to a reliable vehicle
  • Computer expertise in corporate standard software (Microsoft Office) and department specific software including data entry and search skills, and creating and modifying associated documents
  • Must be aware of safe work practices as they relate to job responsibilities and work environment and have the basic understanding of the Occupational Health and Safety Act
