Job Description
Basic Function:
Under the direction of the Environmental Health Team Manager, enforce The Smoke Free Ontario Act (SFO) and Regulation 613/94 there under or any amended tobacco provincial legislation. Tobacco enforcement includes education and compliance strategies, enforcement protocols, legal/prosecution activities, record keeping/reporting, and any relevant health promotion messaging. Collaborates, partners and acts as liaison with other community agencies and government organizations to ensure provision of coordinated and efficient services.
Position Description:
- Enforce the Smoke Free Ontario Act and Regulations and any other provincial tobacco legislation.
- Identify and inspect, in conjunction with other departmental staff, all prioritized public places and workplaces in Haldimand and Norfolk Counties to ensure compliance with SFO, and the Regulations and any other provincial tobacco legislation.
- Identify and inspect, all tobacco retailers in Haldimand and Norfolk Counties to ensure compliance with relevant legislation.
- Recruit, train and coordinate work of youths conducting compliance and enforcement surveys.
- Utilize and document and investigate/surveillance procedures, which may be used in judicial and courtroom proceedings.
- Lay charges and tickets, give verbal warnings, keep records and provide court documentation for infractions as required. Register tickets with the court, provide witness statements, evidence and documentation to crown attorneys, swear court documentation with the Court’s Justice of the Peace, counsel defendants prior to court and be prepared to assist with the prosecution of charges in Provincial Court, Ontario Division as required.
- Provide assistance with the development and implementation of media/public education campaigns concerning tobacco enforcement activities and legislation.
- Respond to public inquiries and complaints regarding the enforcement of the tobacco legislation, especially with the respect to sales to minors, workplace and public places, signage and smoking violations in prohibited areas.
- Work with persons responsible for public places, workplaces, vendors and schools to ensure compliance with appropriate legislation.
- Responsible for relevant data collection and review for program documentation, including regular reporting procedures of tobacco control legislation. Prepare required reports for the Ministry of Health and Long Term Care and management in Chronic Disease Prevention Division, providing information for reports to committee and council.
- Collaborate, partner and act as liaison with other community agencies and government organizations to ensure provision of coordinated and efficient tobacco enforcement services.
- Participate in staff meetings for the purpose of planning, evaluating and problem solving related to administration of relevant enforcement programs.
- Maintain professional competence via participation in professional development/continuing education programs.

Requirements
Knowledge and Experience:
- An undergraduate degree or relevant enforcement background (policing, by-law enforcement).
- Over two years and up to and including three years of experience in law enforcement and prosecution techniques or related fields
- Familiarity with education/compliance strategies and various forms and procedures/protocols employed to enforce tobacco legislation.
- Basic knowledge of the principles of health promotion
Skills and Abilities:
- Excellent community relations and communication (oral and written) skills are required.
- Contribute to the identification and prioritization of areas for improvement within the six dimensions of quality (safe, effective, efficient, timely, person-centered and equitable).
- Engage with colleagues in a systematic approach to quality improvement, including the definition of the purpose and scope; development, testing and implementation of change ideas; and measurement of reach and impact.
- Valid Ontario driver’s license and access to a reliable vehicle
- Computer expertise in corporate standard software (Microsoft Office) and department specific software to data search and entry and to create and modify word processed documents.
- Must be aware of safe work practices as they relate to job responsibilities and work environment and have the basic understanding of Occupational Health and Safety Act.
